Managing the complete legal and operational lifecycle for the Baitarni-West and Burapahar Coal Blocks, from initial notification to physical possession and rehabilitation.

BNB Land Consultancy is providing comprehensive land solutions for GMDC Ltd., a major public sector undertaking, to facilitate the operationalization of two strategic coal blocks: Baitarni-West in Angul and Burapahar in Sundergarh. This ongoing project, active since 2023, involves the complex and simultaneous execution of land acquisition for private land and land alienation for government land. Our role encompasses the entire process, ensuring strict adherence to the RFCTLARR Act, 2013, the CBA Act, and state-specific regulations to secure the Mining Lease area while safeguarding the interests of all stakeholders.

Assignment Details:

Our comprehensive assignment is structured around two critical, parallel workstreams. For private land acquisition, we are steering the entire process under the RFCTLARR Act, 2013. This encompasses initial preparatory work such as drafting the Land Schedule and submitting requisitions via IDCO, followed by managing the complete statutory gamut from issuing the SIA notification under Section 4(1) to publishing declarations under Sections 11(1) and 19(1). A cornerstone of this process is orchestrating extensive public consultations, including district and village-level Public Hearings and Grama Sabhas, leading to the finalization of the R&R Award, overseeing the disbursement of compensation, and securing the final lease sanction and physical possession.

Concurrently, for the alienation of government land, our responsibilities include preparing the requisite Land Schedules, formally applying for alienation, shepherding the proposal through administrative approvals and Grama Sabha consent, and ultimately obtaining the Collector’s sanction to facilitate the legal transfer and physical handover of the land.

Project Objectives:

The core mission of this project is to seamlessly secure the entire Mining Lease area by successfully concluding both land acquisition and alienation processes, thereby enabling the client’s operational timeline. This necessitates a rigorous adherence to all statutory mandates under the RFCTLARR and CBA Acts. A fundamental objective is to foster community trust and ensure social compliance through transparent and inclusive stakeholder engagement in all affected villages.

Finally, our focus is on the timely finalization of the R&R Award and compensation, culminating in the critical handover of physical possession to GMDC Ltd. to empower the commencement of mining activities.

Executing a comprehensive socio-economic survey to establish an accurate baseline for compensating displaced families and planning a sustainable rehabilitation colony.

In 2022, BNB Land Consultancy was commissioned by ArcelorMittal Nippon Steel India Ltd. (AM/NS) to conduct a critical Baseline Survey for families displaced by their operations in Paradip. The project’s core purpose was to move beyond a decade-old Socio-Economic Survey (SES) from 2008 and ascertain the current status of the approved 903 displaced families. This foundational study was instrumental in providing the verified, up-to-date data necessary for formulating a fair and transparent R&R compensation package and designing a detailed displacement plan.

Assignment Details:

Our assignment was a methodical, multi-phase process designed to deliver accuracy and clarity. It began with the recruitment and specialized orientation of the field study team to ensure data integrity. We then undertook the extensive task of collecting current data from the affected families, followed by rigorous data entry, processing, and analytical scrutiny. A pivotal component involved preparing the survey schedule based on the 2008 SES and facilitating the disposal of over 1100 pending claims and objections in collaboration with the District Administration. The assignment culminated in comprehensive report writing, starting with a draft for discussion and deliberation with AM/NS leadership on the final number of eligible families, the R&R compensation structure, and the overall displacement strategy, leading to the submission of a conclusive final report.

The project was guided by several key objectives, central to which was verifying the present status of all 903 displaced families to establish an accurate and current baseline. This data was essential for calculating fair R&R compensation and for strategically planning a rehabilitation colony with the necessary infrastructure. A major objective involved resolving long-pending issues by working with district authorities to dispose of the backlog of over 1100 claims and objections. Ultimately, the goal was to synthesize all findings into a definitive final report that provided AM/NS with a clear, actionable, and data-backed framework for the successful resettlement of the project-affected families.
